These Terms of Service ("Terms") govern your use of the Triple C telematics device, mobile application, and concierge services provided by Connected Classic Car, LLC ("Triple C," "we," "us," or "our"). By using our services, you agree to these Terms.
1. Services Overview
Triple C provides telematics monitoring and 24/7 concierge services for classic car owners, including but not limited to: mechanical helpline support, alarm monitoring, towing coordination, battery monitoring, stolen vehicle recovery assistance, and crash detection services.
2. Eligibility and Account
You must be at least 18 years old and legally able to enter into contracts to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Device and Installation
The Triple C telematics device:
- Remains the property of Triple C until all fees are paid
- Must be installed according to our provided instructions
- Comes with a lifetime warranty against manufacturer defects
- Should not be tampered with, modified, or removed without authorization
4. Fees and Payment
You agree to pay:
- A one-time device and activation fee of $100
- An annual service fee of $99/year
- Any additional fees for optional services as disclosed
Fees are non-refundable except as required by law. We reserve the right to change our fees with 30 days' notice.
5. Service Limitations
While we strive to provide reliable services, you acknowledge that:
- GPS and cellular coverage may not be available in all areas
- Service interruptions may occur due to technical issues or maintenance
- Response times may vary based on circumstances beyond our control
- Stolen vehicle recovery is not guaranteed
- We coordinate with third-party service providers but do not control their actions
6. Your Responsibilities
You agree to:
- Provide accurate and complete information
- Keep your contact information up to date
- Properly maintain the installed device
- Notify us promptly of any device issues or vehicle changes
- Use the services only for lawful purposes
- Not interfere with or attempt to circumvent our systems
7. Intellectual Property
All content, software, and technology used in our services are owned by Triple C or our licensors. You are granted a limited, non-exclusive license to use our mobile application for personal, non-commercial purposes.
8. Limitation of Liability
To the maximum extent permitted by law, Triple C shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees you have paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold Triple C harmless from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
10. Termination
Either party may terminate service with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms or fail to pay fees when due. Upon termination, you must return or allow retrieval of the device if applicable.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of SC, without regard to its conflict of law provisions.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through our app. Your continued use of our services after changes become effective constitutes acceptance of the new Terms.
